As I have always said I would not get a fair trial in Harrison County and I was right. Much of our evidence to prove our innocence was not allowed to be admitted. The judge over the case for 2 years was suddenly replaced with the judge that was over the incident in 2010 that caused me to file the tort claim, that we feel lead up to the retaliation and refused to recuse herself.
This is the story from the very beginning to the very end.

Am I surprised at what the animal control officer said about me on tv and the news papers? Yes and no.
Is he lying? Yes
Has this be exaggerated or blown out of proportion? Yes
Why you ask? Well, here is the last several years of my family's life. If you read it, maybe then you will understand. Nothing in these statements that I have written is written in false light, nothing is sugar coated, nothing is written here except the truth. I have nothing to hide now, I had nothing to hide then. My husband and I are innocent and my children and our pets have been abused by CPS, the animal control officer and the law enforcement officers as well as the others that I chose not to name yet that lied on the stand, not by my husband and not by me. Here is our story....

The following is the FULL time line of the raid upon Frisky Felines Foundation. However if you wish to use your judgement of what you have read or seen in the media and now would like to see the evidence that proves that Bruce LaHue, the animal control officer, is the person that committed the crime in which Samantha and Randell were charged and found guilty of click here. It will show you everything that was given to Samantha from Otto Shalk who is the prosecutor on this case. Samantha does not have all of the photos that were shown in court because Mr. Shalk never gave them to her or her attorney, nor Randells attorney. Several photos of the cats were sprung on the defense, and though the defendants really didn't get much of a chance to look over them they were allowed to be entered for the state, even though this case is only about 4 cats and 2 children.
These are the Lee children above, Candace (age 17 at the time), Josh (age 19 at the time) and Parker (age 14 at the time), this photo was taken on 6/17/2011. These kids USED to be happy. These children. even years later, are distraught, suffer from post traumatic stress disorder and anxiety. Candace was hospitalized in February 2012 due to anxiety and depression brought on by the raid in November. Then hospitalized from November 13, 2013 to November 20, 2013 from the result of the verdict.. These are the children that you non believers call "victims", the ones you said you "feel so sorry for", these children do admit they are victims, but when you ask them who have abused them they say "Bruce LaHue, the animal control officer, CPS case worker and supervisor; Shannon Ambrose and Dale Stroud, a stalking Milltown Town Marshal; Ray Saylor, lying deputy; Gary Gilley and several other people that have lied such as Jeri Warren". Just ask them anytime you see them, they'd be more than happy to give you their side of things as NO ONE has ever bothered to ask these children how they feel about having their pets taken from them, murdered and held hostage. No one has bothered to ask the children if they felt they were neglected. No one has bothered to ask the children if they enjoyed running the no kill shelter. The children very much want to be heard, but yet, their pleas to speak falls upon deaf ears because they are/were "minors".
During this 2 years of the parents fighting being wrongfully accused these children have said if their pets do not come home they really are not sure if they will ever own another pet because they cannot bear losing another animal in this manner, at what point should a 16 year old child live in such fear that the government will come take away his pets? It should never be that way!
Samantha and Randell Lee are the founders of Frisky Felines Foundation A NO Kill Cat Shelter that was started after the Lee's took in several stray cats and realized their county had a problem. They wanted to make a difference in their community so they started a rescue/adoption shelter (home based rescue with intent to build a shelter) to help not only cats, but families with cats that are in need and to keep cats out of the local kill shelter.
On November 17, 2011 the Lee's believe they were raided out of retaliation. This has cost 6 cats and 1 rooster their lives. The children were humiliated by the lies the ACO stated, rumors that began because of the defamation to the point in which Candace (the 17 year old daughter) was hospitalized in February 2012. 4 cats were murdered at the hands of the ACO because no cats in the Lee's care were ill enough to die! Cats were withheld medication by animal control, as well as possibly food. Donors have donated to animal control to take care of the Lee's pets believing they are helping care for ill cats when in fact the cats were healthy and several had recently been seen by a veterinarian. Samantha had Kenya at the vet on 11/14/11, was back at the vet to get medication prescribed by the veterinarian for Chargheera and Mufasa which included any other cats that started with symptoms until the other "medication" came in that Samantha ordered what the vet suggested for the entire shelter. People complained as to why they have to take care of the Lee's pets when the Lee's should have to, but the Lee's were doing just that. The Lee's never received any citation or warning to take care of their pets, they didn't even know why the animals were seized. All that was stated was that Samantha picked up cats from a lady in Louisville the night before. The Lee's were refused to see the warrant even after asking 3 different times. The Lee's had to legally fight for one of the dog's that animal control wanted the Lee's to take back, pay to put to sleep or pay $1000 for an exploratory surgery. These animals were not in any harm before leaving the Lee's home, but they have been since being in animal controls care. The Lee's fought for 2 years, spending over $10,000 to get their animals home. Every time the judge swayed to the animals going home another cat died. Including up to the week before the Lee's trial, we are talking 2 years later cats were still dying. The judge told the Lee's attorney, in order for the animals to be returned that Samantha would have to have separate building for the cats to go to, she'd have to run an actual shelter with posted hours. So Samantha did that, she bought a building for the cats to go home. However, every ounce the Lee's gave to prove their innocence in civil court to get the animals out of animal control then something else would happen to the point the animals were held the entire 2 years.

Early in 2009, Samantha and her neighbor, Ray Saylor, who is the Milltown town marshal (which is the next county over) got into it over Samantha's horses. This person said he was going to call CPS on Samantha. 12/15/09 CPS visited the Lee home, the Lee's were asked to come to the CPS office on 12/17/09, in which they did, before leaving the caseworker asked them if they'd allow her to open a case on them. The Lee's said no. CPS unsubstantiated the allegations on 12/21/09.
On 1/6/10 the case worker, Shannon Ambrose, then "called in" a welfare child check (on a family with no case). The same neighbor, Ray Saylor, answered the call and went to the Lee's residence. Saylor had been stalking the Lee's for months, the Lee's did not trust him. He told Randell he was at the house to do a welfair child check. Randell got Samantha and told her. Samantha told him he was not allowed in the home. Saylor started arguing with them and they explained they were cleaning the basement where it had flooded, they had moved Josh and Candace both out of their basement bedrooms until they could get the flooding under control, and were cleaning the displaced, waterlogged items and were busy. The family was washing down stuff in the kitchen and they needed to get it finished. Saylor refused to leave and argued with Samantha that he was going to come into the house, that he was there to check for heat. Samantha told him, "look up you can see and smell the fireplace." He then said he needed to check for hot water. Samantha told him that both he and the caseworker knew that she is disabled and REQUIRED aqua therapy daily in order to be mobile. So heat and hot water were essential in the Lee household period. He said he didn't care he needed in the house to check on it. Samantha had to stand outside in the cold for 50 minutes fighting for her right to privacy because this town marshal would not leave, he even threatened to lock up Randell for a joke he said, remember, this is a neighbor and a town marshal of another county who had no warrant. Samantha was on the phone for 20 minutes arguing with the caseworker that they had no right to be there and they were not coming in and the family was busy. The caseworker told her someone was going to get into that house that night if she had to come out herself, Samantha said she had already offered Saylor neighbor to neighbor, to come back in 2-3 hours after they got done what they were doing, he refused that and they were not going to allow him in, they felt he had no right to even be there. The caseworker argued that she'd have someone else to come out, Samantha argued no, they weren't going to stop until they were finished. Samantha who is disabled and cannot be in cold air or talk on the phone long told Ambrose she was then in pain and had to get off the phone and was going in but was not going to let the town marshal in, the caseworker kept arguing and would not let Samantha off the phone. She kept on Samantha asking Samantha to let her open a case on the family, Samantha said no, so she started again on Saylor getting access to the house. Again Samantha said no, this went on for about another 8 minutes. Finally Samantha near tears in pain told the case worker that she can have Saylor come back in 2-3 hours after they got done. Ambrose said no, he was going to get in then. Samantha said no he isn't he can come back in 2-3 hours but I am hanging up. Then the caseworker said "FINE, but you BETTER let him in and he will be there in TWO hours." Samantha told the caseworker the family would have to stop what they were doing to clean up the kitchen floor, take all the dirty items back down to the basement and cram all the cleaned items in the loft, etc. Ambrose also said, that she would be out the next day to discuss opening a case on the family. Samantha handed the phone to Saylor, told him to come back in 2 hours and walked into the house. They didn't go in before because they feared what Saylor would do, they do not trust him, they were warned about his behavior when he moved into the neighborhood. The Lee's who keep to themselves were shocked to have to deal with this. It took Samantha 50 minutes to fight for her right to privacy.
On 1/7/10 Shannon Ambrose said she wasn't coming out because of snow, but asked Samantha if she'd agree to opening a case on the family. Samantha said no. Ambrose said she will discuss it with her when she comes out the following day.
On 1/8/10 Ambrose said she wasn't coming out because she didn't feel well, but asked Samantha again if she'd agree to opening a case on the family. Again, Samantha said no. Ambrose said she'd see her on Monday and would discuss it then.
On 1/11/10 Ambrose came out to the house, was 30 minutes late at that. The reason Samantha let her in is because she was tired of the harassment and wanted to set the record straight with this case worker. Ambrose lied the minute she opened her mouth. Said the school called in a complaint about the kids. Samantha told her "hold it right there, I know you are lying, you had to of called the school. And the reason I know the school would not had called you is because I have an open relationship with that school and the principle because of Josh!" The caseworker never denied and records show the caseworker did call the school. Then when Samantha called her on that, she started in on the cats, saying this cat had feline leukemia, this cat was sick, that cat was sick, that cat was emaciated, just on and on and on. Samantha told her she was a former vet tech, had an animal educational background, and that some of the cats were currently under a vets care and that one cat that was pointed out was not emaciated, that she was long and lanky. Then she started in on Samantha homeschooling Parker. Samantha has followed the Indiana Department of Education laws on homeschooling, the caseworker didn't even know what the laws were and Samantha had to educate her. As the caseworker was getting ready to leave, once again asked if they'd allow her to open a case on them. The Lee's said NO again. The caseworker explained it would be an informal case plan and that she would be able to get them a grant to finish remodeling their home, to get new kitchen cabinets, floor, furnace, etc. Samantha said "we do not agree to an open case, we do not want the states money, we will fund the remodel the way we have been out of our own money". With that the caseworker left. The Lee's felt they finally put things straight with this caseworker.
1/12/10 Per documented CPS records Shannon Ambrose told her supervisor; Dale Stroud and the director of CPS that Samantha and Randell were cat hoarders. With that the director told this caseworker to contact animal control.
1/13/10 Ambrose called Samantha and told her to stay put she was on her way back out to the house, even though Samantha told her she didn't have time to meet with her, Ambrose refused to listen and made Samantha stop to meet with her. Ambrose and Stroud, as well as 2 sheriff deputies arrived at the Lee home. Ambrose told Samantha and Randell they were there to detain the children (without a warrant and without exigent circumstances) and that she called animal control and he would be there shortly. The Lee's were dumbfounded as the last thing either of these parents would do would be harm their children or their pets, both are the world to them. They knew something did not make sense but knew that animal control would set this straight. So when Bruce LaHue, the ACO arrived at the home Samantha spoke with him as he stood in the Lee's living room for 20 minutes commending Samantha on a job well done. He questioned her about a few things just to assure her knowledge. As LaHue went to leave he looked over at the caseworker as though to say goodbye and with that his demeanor changed and he said he would be back the following day to seize all the cats. It did not matter that the animals were under veterinary care just 30 days prior, did not matter that Samantha had proof of that, did not matter that Samantha provided proof of medication the cats were on. Nothing mattered.
1/14/10 The ACO came back and took the cats and coerced Samantha in surrendering Parker's ducks. He said that if she didn't he would just get abuse charges on them also. Samantha felt that wouldn't happen and that surely she'd see a judge and the judge would see their was no reason for them to even be on her property. She just wanted him gone, and not sure of what was going on she surrendered the ducks. LaHue said they can keep the Labrador Retriever, the house chicken and the roosters. As LaHue was leaving he told Samantha and Randell that a bench warrant would be issued and they could see about getting the cats back. However, that has never happened.
In September 2010 AFTER waiting on the bench warrant that the ACO told her and Randell that would be issued, Samantha contacted "Joyce" at the prosecutors office, who claimed to the be the investigator and told her that she wanted the cats back. The investigator told Samantha they were waiting on test results to come back. Samantha told her she knew that was a lie as it does not take 8 months to get test results. Then the "investigator" said they were still being used as evidence against her, but would tell LaHue. The investigator kept on Samantha wanting to know where her horses were, this was 8 months AFTER the seizure, they could not find the horses and were still looking for them.
**Fast forward to evidence provided. The ACO stated in his probable cause affidavit to Judge Roger Davis that he saw a cat in a cage with crusty eyes and had an emaciated appearance. Animal Control's veterinarian said this cat weighed 8.8 pounds and that this cat was considered OVERWEIGHT, he scored a 6 on the Purina Body Scale but yet LaHue under the penalty of perjury to steal these cats, said this cat was emaciated. Since the 2011 raid Samantha has discovered ALL 15 cats he illegally seized he killed on 2/1/10. His excuse....."Mrs. Lee never returned for the cats so they were put to sleep".
2/28/11 Samantha filed a tort claim on the ACO for what he did in 2010. He had a duty to realize the cats in the Lee's care were being taken care of especially providing vetting documentation to him. The tort claim was mailed out to the Harrison County Animal Control, Harrison County Commissioners and Harrison County Council on Feb 28, 2011. It was received by the parties on 3/2/11, the parties had 90 days to respond, no response meant the Lee's had the right to sue. This would had been approximately around June 2, 2011.
The Lee's are not claiming this to be anything related to this story, but it will be added. Sometime during the summer, between June and September the Lee's barn was broken into. Since the prosecutors office was looking for the horses they could not call in the theft done at the barn. Keep in mind to this story, Samantha has a half brother that she no longer spoke to the family. The half brother knew where the property was and knew the horses were there. At that time Samantha knew that her half brother was an Indiana State police officer (or at least she thought he was).
9/22/11 Samantha received a call from a woman, someone she does not know. This woman called 3 times between September 22 and September 24. Samantha was busy and had not had a chance to return the call, but did save the voice mail from 9/24/11. This woman who lived in Paoli Indiana which is not local to Harrison County but not too far away asked Samantha to take cats from the Orange County Humane Society. Samantha did not do so because she was not in a position to help at that given time. This person that called Samantha, the person Samantha does not know is the EXACT person that referred No Kill Louisville to Samantha to help Jeri Warren, that is HOW No Kill Louisville came in contact with Samantha.
10/28/11 the Lee's horses were stolen by the Harrison County Sheriff's department and have been at a rescue since then. Parker the youngest of the Lee's swears up and down LaHue and Saylor are behind this. The sheriff's department stated the horses were at large, however they broke into a locked barn, the fence was cut and told Samantha she would probably be charged with something over the horses, Samantha told the Sheriff she didn't see how since she did not believe that the horses were out but that someone let them out. It was found out later that the Sheriff (same sheriff that was part of the 2010 incident) said the horse rescue cut the fence, the horse rescue told Samantha they were never on her property and that the mounted sheriff patrol brought the horses to the horse rescue. The Prosecutor saw no problem with the horses, just asked the Lee's to make the paddock bigger, however, this was October, the weather was not feasible to move a fence but the Lee's were trying. Not to mention the Lee's had the horses in a smaller area of the 6 acres due to hunters. (In February 2012 the prosecutor asked Samantha to surrender the horses to the horse rescue. Samantha told the attorney that she tried to do that back in November after the raid because with fighting to get the animals back and protect the kids she didn't have time for the horses and the horse rescue refused, but Samantha did surrender them in February 2012. In March the prosecutor asked Samantha to take the horses back. However, the Lee's could not take the horses back because of the raid, they lost the property the horses were and they knew they could not properly care for them with everything they were going through). The horse rescue is now saying the Lee's owe $9000+ on horses that the prosecutor asked the Lee's if they would surrender to the horse rescue so the rescue could adopt out to recoup their losses.
November 5 and 6, 2011 the Lee's took Samantha to Tumbleweed for her birthday dinner. When they came home Ray Saylor was sitting in his truck in front of the Lee's home, when he saw them he sped off. The Lee's did a little more work in the basement that night. November 6 Randell and Samantha ran out to get some errands done and told Josh, Candace and Parker to do their chores and put up their items brought up from the basement. Before they left Samantha had a stomach ache and thought maybe she had food poisoning but still went to get errands done. When Samantha and Randell got home, they helped the kids in the living room to put up more things and then started on the basement work again. Samantha not feeling well helped some, but not as much as before because she was nauseated.
November 7, 2011 Samantha was still not feeling well, it had been over 24 hours and figured maybe it wasn't food poisoning. Not feeling well, she had an appointment for Speck and Gizmo at animal hospital she used to work at. She didn't feel like going but Gizmo needed cosmetic surgery and Samantha did not want to miss the window to get that done. So even though she felt nauseated she drove from Depauw all the way to the East End of Louisville to make sure the cats were seen. Speck had an episode the day before but was fine, she still wanted him examined to make sure. She also wanted to address the ears of these 2 cats. She had been told by her other vets the cats had ear mites, but nothing ever cleared it up, so Samantha wanted a swab test done to confirm this problem was ear mites. The test came back negative, these 2 cats did not have ear mites. Samantha left Gizmo over night for surgery and took Speck home.
November 8, 2011 Samantha was supposed to go back and get Gizmo but she felt so bad she asked for him to stay over night.
November 9, 2011 Samantha went back out to get Gizmo and stopped at another animal hospital in Indiana that she uses to pick up Diamond's Valium for her seizures and discussed with the vet how Diamond had been doing and discussing upcoming blood work on her. She was to take Diamond in for blood work the following week. She went to get Gizmo and went home. Still not feeling well, she did a little here and a little there trying to get things done.
November 12 and 13, 2011 the Lee's were doing more work in the basement. Candace had gone to a friends house for the weekend. Randell and Josh were in the basement moving things to the kitchen while Samantha and Parker were going through them to see what needed tossed and what needed to be saved. Josh was not feeling so great because he had been dealing with the same stomach bug Samantha had. Samantha had gotten over it by the 12th and was back on task, and now Josh was doing things here and there like she was. Moving things out of the basement on weekends had been a regular occurrence in the Lee home since around October 20, 2011. Josh had been forced to make a bedroom in the living room because they had had enough of the turmoil and disruption of their lives over the drainage problem that they thought was fixed and/or under control. They were at this point trying to empty out the basement without completely having everything dumped on the two upper floors, they were trying to avoid constant clutter and trying to control the clutter by doing it at a pace, brought up on weekends, put up during the week, then start over. All while trying to provide normalcy for the kids and to have the house back to normal for Thanksgiving.
November 14, 2011 Josh woke Samantha up at 6 am and asked her to take him to the ER. With this bug you'd feel ok, minor discomfort but every time you moved you'd feel like you were going to vomit, so it was hard trying to do anything. This was his 6th day and Samantha told him hers lasted 6 days and he should just sleep it off, he'd feel better in a little while. He tried that, but came back and insisted he wanted to find out what was going on. Samantha knew she was going to take Kenya to the vet and told Josh she felt he'd be fine but if he really insisted she'd go ahead and take him and take Kenya later. So Samantha took him to the ER. There Josh did vomit, and was diagnosed with a stomach virus and was sent home. Samantha went home to get Kenya, her appointment was at 2 pm. She tried to get Kenya in earlier but the vet was not on the premises until 2 pm. Kenya had slight mouth breathing the night before. Samantha monitored through the night. She did not have any eye drainage or nose drainage, which are signs up an upper respiratory infection. Samantha thought it was odd, she was just exhibiting slight mouth breathing. Monday morning, Kenya was in the same condition, but Samantha was concerned. The vet looked Kenya over, did some blood work and diagnosed her with a URI. She was put on Clavamox and sent home. Samantha that night had a house to get back into shape and 2 patients to take care of. Josh was laying around, he was still nauseated, but was feeling better. Samantha put Kenya in quarantine and got her set up for the night. Samantha then did some things around the house. She had Parker do his chores which was clean out the litter boxes on the main floor, dump, wash, sterilize and refill. Candace was supposed to do her chores and refused to do so. Samantha has a 3 day window before initiating punishment, this is to teach the kids cause and affect. Samantha did ask Parker to go ahead and pick up the kitchen of things out of place. Since that is Candace's job Parker expressed to his mother that was not fair because he did his chores Candace and Josh should do theirs. Samantha agreed with him. Josh did a few of his, but it was understandable he still had some nausea. Samantha's views on disobedient children (well hers) is they will never learn as long as she does what they don't want to do. Her kids would rather have everything take away than to do chores, these kids will tell you that. When they want something however they work their butts off, so they have shown they know what needs done and how to do it. So Samantha fussed at Candace, told her to do her chores, her reply was NOPE, so Samantha let it be. Time was ticking away on Candace getting grounded.
November 15, 2011 Since Josh had a catering event on the 16th, Randell had suggested that Samantha run errands instead of coming home (to save gas). Samantha wanted to come home and clean and go back and get Josh, this is the norm for Samantha. But Samantha had errands that really needed to be done so she decided she would. In order to do this, Samantha needed to "precouperate" to prepare. Samantha was feeling better physically with her RSD but knew she still had to watch how much activity she could do. So she rested from about 7 pm on. She gave the kids a list of things she wanted done. One of the main things is Samantha told Josh to go to the basement and bring up any and all dishes he had and wash them. Josh's idea of that was to bring up the dishes and put them in the sink and leave them. Samantha not knowing she had to hoover over kids aged 19 and 17 trusted them to do their chores, well they didn't. And Samantha did not realize until the next morning.
November 16, 2011 Samantha waited for the vet to call about Kenya's blood work. Jeri Warren called Samantha 8 times between 8 am and 11 or 12 pm, we will go into that conversation down below. Samantha did not want to tie up the phone line if the vet called so did not called Warren back until after she spoke to the vet. When the vet did call she asked how Kenya was doing, Samantha told her she was doing better but had not bounced back as quickly as she felt she should had. She was not eating still, and that Samantha was hand feeding her a gruell and some canned food. The vet said she'd like to add another antibiotic, Samantha said ok. Samantha then discussed the other cats with her. Samantha told her that Chargheera and Mufasa had started with signs of an upper respiratory infection, could the vet give them a bottle of Clavamox. The vet said "legally I cannot do that but I can order a refill for Kenya and ok you to give it to them." Samantha said that would be fine, "what do I do about all the other cats? Most likely they will start with it too and I don't want them all getting it." The vet told Samantha "I suggested you put them on L Lysine, it will help ward it off. I don't have any in stock but can order you a bottle, it's kind of pricey though." Samantha ordered the L Lysine, told her she'd come pick up the meds for Kenya and the other cats in a couple of hours. Samantha then called Jeri Warren back, and told her she never said she'd be there at 7 am that she told her after 4 pm. Samantha left to pick Josh up at school, went to the vets office and got a bottle of Clavamox, a bottle of Zeniquin and 2 cans of food for Kenya the vet suggested. She also asked the tech if she knew of any maintained feral colonies as she needed to pick up 2 feral cats and needed someone to take them. The tech gave her the number of Floyd County animal shelter and a private number. It was written down on a yellow post it. Samantha left there, dropped Josh off then headed to Louisville to get Jeri Warrens cats.
The message left by Jeri Warren......
Jeri Warren started at 8 am calling and yelling at Samantha "WHERE ARE YOU, YOU SAID YOU'D BE HERE AT 7", "WHERE ARE YOU ARE YOU COMING TO GET THESE CATS?" Just on and on and on and on, very rude, very hateful, and very panicky. Samantha was put off and could not understand why she thought she'd be there at 7 am when she never said that, why she was in such a hurry to get Samantha there to get the cats, why she felt the need to call 8 times. After speaking with the vet Samantha told her that she'd be there after 4 pm, not before that.
The visit with Jeri Warren.........
Samantha went to get 2 feral cats from a lady begging her for help (this lady was referred to Samantha, Samantha did not seek this person out like the ACO has tried to make the public believe). It was put to No Kill Louisville, that if this woman did not rehome these 7 cats that she would be evicted. You can read the emails between No Kill Louisville and Samantha. They contacted Samantha. Samantha is a very compassionate person and tries to help people, since the cats were feral she said she would help because the cats would not be part of Frisky Felines Foundation as Samantha told this woman she was full and could not take anymore inside, but would help her since they weren't coming to the rescue and would put them with a feral colony. The goal Samantha was trying to achieve was to keep this woman in her home.
Samantha felt sorry for this woman who seemed upset having to rehome these cats. There was a mom and 6 6 month old kittens. Jeri had told Samantha her neighed was shooting at them. Samantha offered to go and speak with the neighbor that there are feral cat laws, Jeri said no. Samantha said she could mail paperwork regarding such to him, Jeri said no to send it to her and she would tell him. Samantha offered to build her a feral cat housing behind her trailer (her trailer backs up against the woods, no other homes behind her), Jeri said she could not afford that. Samantha offered to pay for it all, Jeri said her landlord would not go with that. Samantha said she'd be willing to talk to him to see if he would, the situation was put to Samantha that the cats were wondering around and that bothered this neighbor that was shooting them. Samantha then offered to house the cats at her property and give her time to find cat friendly property to move to to have these cats. Jeri said "no I want you to keep them." Samantha told Jeri, "I'm not keeping them, they are going to a maintained feral colony, I just don't have the time needed to work with these guys so I will find someone that can so they aren't being shot at and you won't lose your home." So with that, they transferred the cats to Samantha's carrier and Samantha left.
November 17, 2011 about noon the sheriff's department was on the Lee's porch. It was guess who....Ray Saylor, the same town marshal that Samantha had gotten into it over the horses. He was with another deputy, who happened to be part of the 2010 seizure of the Lee's cats also. So we have Ray Saylor, part of the 2010 CPS case, Deputy Asher, who took the horses in 2011, who was part of the CPS case in 2010 and Deputy Gilley who was part of the cat seizure in 2010. The Lee's live in a small county, but not THAT small! Needless to say, out of fear they refused to answer the door. Randell and Samantha will NOT open their door to Ray Saylor EVER again! So they waited for them to leave, they never did. They staked out the Lee's home until they got a warrant to enter.
First Saylor and Gilley were at the residence, when the Lee's refused to answer they walked around the house. Around 2 pm they called in LaHue. LaHue came, knocked and Lee's refused to answer the door, they waited for them to leave. They decided to walk around the yard, knock on the back door and walk around some more. There were 2 dogs in the back yard. Brownie who is a Chocolate Lab, who is a full time outside dog, they had tried to make her an inside dog, but she just would have nothing of it. The other dog was Coal a Black Lab, who was not their dog. He belonged to another rescue who dumped him on the Lee's when they said they were going to go come back and get him. He came with another lab who Samantha did rehome. Coal and Brownie were out back, Coal is a great indoor dog but he prefers to be outside with another dog. Samantha had put Bindie outside in her training crate so she could clean the house and put Coal in one of the kennels so not to have to tie him anywhere. Samantha saw LaHue and Saylor take these 2 dogs about 2:30 pm. She thought how odd, they took the 2 dogs and never issued a warrant. That is because they claim that Coal was, let me put this how LaHue said it "could see his spine and ribs from a distance.....was told to do whatever necessary...." He seized BOTH the dogs with an exigent warrant based on fabricated statements without any proof whatsoever. The photo of Coal PROVES you could not see his spine and ribs from a distance. See Coal's page for Coals photo, the report, etc. They then got a warrant to get into the house.
NOTHING was ever stated as to as to why the ACO seized ALL the pets on the property, except that Jeri Warren had a complaint on the condition of the house. Samantha never gave her the address of the house. Jeri Warren said the Better Business Bureau googled the address and gave it to Warren. Later there were 2 different reports, 1 was the above, the other was that Warren reported the cats stolen by Samantha. Gilley says Warren says Samantha stole them, Saylor says she complained about the house. See the depositions for these statements.
In addition to this the Lee's were not allowed to see the warrant UNTIL AFTER all the animals were removed out of the house( they asked 3 times)
The Lee home was a mess, something Samantha has never denied, BUT the house was a mess for VERY good reasons and I will state those here for you to clear up any rumors you may have heard or will hear.....
CONTROLLED CHAOS
In September the basement flooded, had 8 inches of water in it, then the sump pump broke and what water they could get out just came right back in. The Lee's went to get another sump pump and they could not get the type needed for their basement. Eventually they did get the correct sump pump but things had gotten worse in the basement to the point that the beginning of October Samantha and Randell MADE their nearly 19 year old son move out of his basement bedroom until they could get all the water logged items outside and burned/tossed. Which was a task in itself. It has been reported that Samantha and Randell made their 17 year old daughter, another report says minor child sleep in this water logged room as late as November, the ACO made the statement that Parker had been sleeping in the basement, however, none of that is true, that is why the basement looked the way it did, NO ONE was using the basement since the first week of October, it was being emptied out due to the mildew, everything was water logged and was going to be burned, but you can't burn wet things nor is it safe to walk on the floor with water because of the cement. This is an UNFINISHED basement. It has a concrete floor and concrete walls.
Josh (who is the oldest child) moved to the living room. Josh is a typical teen age boy and is not the cleanest unless he wants something from his parents then he is amazingly neat. Which Samantha and Randell feel is a typical kid. From moving Josh to the living room the living room then became smaller, crowded and consisted of things the living room didn't have before which all belonged to Josh. In order to get Josh's "bedroom" in the living room Samantha had to take down her office and turn it into a sitting room to house the living room furniture, so Samantha had to condense the office (which is upstairs in the loft) to another part of the house. This meant purging items and getting rid of things that they no longer wanted, etc. They had to move holiday decorations around to utilize attic space better which is why Halloween things were out.
Josh also asked Samantha if he could take over the kitchen (he wanted to be a chef), Samantha knew not to do that, but Josh promised to keep up with it all and keep it clean. So the living room and 1/2 of the kitchen was then Josh's responsibility. With this, Josh as a typical teen enjoyed making the mess when cooking but never wanted to clean up afterward and Samantha like a typical mother had to get on him over and over.
On Nov 10, 2011 (Thursday) feeling a little better Samantha started cleaning some more. Candace was cleaning their bathroom and their bathroom walls had mildew on it (not mold as the media reported) and Candace was wiping the walls down (the mildew was on the glue from where they took the wall paper off in order to paint the walls. The mildew came not from lack of ventilation as stated in reports but due to the door being shut after showers and the fan for the vent not being turned on, it was also reported this bathroom had no ventilation and it does.) Samantha told Candace to stop wiping the walls down until she went to to the store to get facemasks. (There is a photo where you can see the wall was being wiped down), but these parents are being charged for having mildew on the bathroom walls because Samantha halted cleaning that until face masks were available, they'd rather the family clean it than take safety precautions.
On Nov 12, 2011 (Saturday) The family was trying to get everything washed up and stored away. There were clothes hampers of stuffed animals brought up, Josh's items out of his room, the stored canned goods, the furniture that still needed to be moved upstairs, etc. All of the items being brought up from the basement were placed in the living room and in the kitchen. Some of Josh's items were on the living room chairs. The items that were ready to be thrown in the washer (that they were trying to save) were on the kitchen floor across from where the washer is, which consisted of a dog bed, a pillow case and a rag all from the basement, a jacket and pair of shorts there were other items in clothes hampers that were to be washed in the washer and other various things needing somewhere to go were setting out. Josh was still feeling off and was not helping as much due to feeling nauseated and Candace was not home to help, so it was just really Samantha and Parker.
On Nov 13, 2011 (Sunday) was rolled over cleaning from Saturday. Josh was still feeling off and on with not feeling well. The family kept going through things. Kept on the same routine of getting ready for Thanksgiving. They brought more things up to be washed in the bathroom, some of it was on the floor, etc. Samantha did not mop the kitchen floor, living room floor, or the kids bathroom floor because they never got finished and was waiting to mop once that part of what they were doing was finished. Kenya, an adoption cat started acted odd and Samantha had planned on taking her to the vet the following day.
Nov 16, 2011 (Wednesday) Samantha got home and discovered Candace and Parker did not do their chores. This made Samantha mad as there was so much that needed done by Friday night. Samantha did not want to wake Candace because of school, so she punished them instead of doing their chores for them, she left them to do the next day after school with additional chores. If it wasn't holiday coming up she would had grounded them from their friends like she normally does.
Nov 17, 2011 (Thursday) Samantha got up to get a head start on getting the house back in order and since she punished Candace and Parker she was trying to get her chores out of the way so she could help the kids get the house back in order, Samantha and Randell soon learned they were being staked out.
The State Vet.....
Now, keep in mind the raid was on 11/17/11, the state vet did not see any of the animals until 11/21/11.
The state vet reports that 21 cats scored a 1-2 on the bcs, which says they were emaciated with bones visible. There are only 2 determinations regarding that report since the Lee's had a few overweight cats. How can NO cat on the bcs not score a 6 if they were overweight??? The state vet said, when she examined the cats that NONE of the cats were of average weight. You can look at the photos during the raid and the intake photos and the photos do not match the report by Dr. Jody Lovejoy who claims all the cats were either underweight or emaciated. So either she is lying or the aco starved the cats to get low body condition scores, or worse to make them die. I had cats at the vet on 11/14/11, 11/8/11, 11/7/11, and 5 on 10/13/11. The only cat that was underweight was Kenya, the cat with a URI. 5 cats were spayed/neutered on 10/13/11, 1 cat had surgery on 11/8/11, so how can these cats go from good body weights all the way down to a 1? This ALSO includes Jeri Warrens cats, her female cat scored a 3. The cat was in the Lee's care less than 24 hours!
It is rumored that there was feces all over the floors, on the kids beds, on the table, counters, etc. That is a lie, yes, there was SOME feces in the house, it was generalized by the back door which was by a litter box and another litter box. A couple of cats were being treated for coccidea and had loose stools. The aco and the cops both testified that "these cats had it coming out of both ends", and that is a lie. ( Actually this is the same statement stated in the paperwork in the 2010 illegal seizure.) They say the poo was old and that is a lie also, before Samantha went to bed the night before she checked the by the litter boxes because she wanted to make sure the litter boxes didn't need to be scooped before going to bed, because if they did the cats may go outside of the boxes before she got up in the morning. Maintaining the litter boxes is a paid job of Parker's. There was some poo in the boxes but not very much, there was enough room and fresh litter available in the boxes. They are saying the litter boxes weren't touched in weeks or months, however, Parker just washed, sanitized and refilled the litter boxes that Monday evening, you can see the fresh litter in the photos. The reason there was feces there is because the Lee's were staked out for 5 hours and no one could not tend to the main floor at all. Samantha laid down at 11 pm, got up around 10 am, she started working on the upstairs litter boxes so she could get her chores out of the way to be able to help Candace and Josh when they got home from school and to help Parker once he started doing the main floor. So for a total of 18 hours the litter boxes were not tended to. Not to mention when the "authority" came in the house they didn't "walk" through the house, they were skipping around, flying about like they were giddy children. Even knocked over a large dog waterer. The cats were freaking out and the Lee's have never seen their cats act like that. First the cats were all calm, laying around, but then started running about the house. It was really sad to not be able to comfort them, most of them knew what was going on. The floors were marked up from tracking the water from the basement throughout the house and coming in and out of the back door not from feces.
That pretty much describes what happened. Was the house a mess?, Yes. Would a simple, clean it up suffice? Yes. Were the animals generally in good health? Yes. Was veterinary care provided? Yes. Did anything warrant a seizure? No! As a matter of fact the house was cleaned within 24 hours. The rest of the time was spent trying to protect the kids and cats.
The ACO is out to destroy Samantha and has already defamed her on TV and to the news papers, why? Is it because she filed a complaint and now it may be found out what he has done and possibly is doing to other people and how for no reason he is killing HEALTHY animals that STILL LEGALLY belong to people? Does he want to give her such a bad name that no one will believe her once she speaks the truth to the community of how he is hurting innocent animals? Is it because she is standing up for her family's civil rights? When asked what his job consists of he stated and I quote "seizures, impounds and helping the sheriffs department build criminal cases." Really? Since when does an ACO's job consist of seizures and helping build criminal cases? What happened to issuing citations/warnings that is LISTED in the Harrison County Ordinance?
The Charges.........
2 cats died, 2 were euthanized.
Pumpkin an 8 week old kitten died on 11/26/11, the Lee's believe they know why, but cannot say yet.
Sagwa, Parker's cat was euthanized on 11/28/11, the Lee's believe they know why, but the animal control vet said she was euthanized because animal control could not afford to vet her after she had a seizure in their care. Seriously?? When Diamond had a seizure in Samantha's care, Samantha took her to the vet, Diamond was put in the hospital for 2 days, had blood work done, etc. Samantha paid for it.
Garfield, Parkers cat was euthanized on 11/29/11 due to being depressed, lethargic and sick. The Lee's know why he got sick, however, the aco's vet said he was euthanized because animal control could not afford his care.
Abbigayle died on 12/14/11 after being starved to death for 8 days. Animal control knew this and documented this, but never provided any vet care for Abbigayles anorexia.
These 4 cats are the charges that the Lee's are facing, charges for something they did not do, had these cats been in the Lee's care, they would had been vetted and alive today. Do you really believe the $7000 vet bill came from vetting these healthy cats or from the $300 an hour the animal control vet charges to look at 36 cats, 3 dogs and 4 chickens???
These people behind this illegal seizure need to be fired and put in jail for child and animal abuse as the accusers are the abusers.
On November 17, 2011 the Lee's believe they were raided out of retaliation. This has cost 6 cats and 1 rooster their lives. The children were humiliated by the lies the ACO stated, rumors that began because of the defamation to the point in which Candace (the 17 year old daughter) was hospitalized in February 2012. 4 cats were murdered at the hands of the ACO because no cats in the Lee's care were ill enough to die! Cats were withheld medication by animal control, as well as possibly food. Donors have donated to animal control to take care of the Lee's pets believing they are helping care for ill cats when in fact the cats were healthy and several had recently been seen by a veterinarian. Samantha had Kenya at the vet on 11/14/11, was back at the vet to get medication prescribed by the veterinarian for Chargheera and Mufasa which included any other cats that started with symptoms until the other "medication" came in that Samantha ordered what the vet suggested for the entire shelter. People complained as to why they have to take care of the Lee's pets when the Lee's should have to, but the Lee's were doing just that. The Lee's never received any citation or warning to take care of their pets, they didn't even know why the animals were seized. All that was stated was that Samantha picked up cats from a lady in Louisville the night before. The Lee's were refused to see the warrant even after asking 3 different times. The Lee's had to legally fight for one of the dog's that animal control wanted the Lee's to take back, pay to put to sleep or pay $1000 for an exploratory surgery. These animals were not in any harm before leaving the Lee's home, but they have been since being in animal controls care. The Lee's fought for 2 years, spending over $10,000 to get their animals home. Every time the judge swayed to the animals going home another cat died. Including up to the week before the Lee's trial, we are talking 2 years later cats were still dying. The judge told the Lee's attorney, in order for the animals to be returned that Samantha would have to have separate building for the cats to go to, she'd have to run an actual shelter with posted hours. So Samantha did that, she bought a building for the cats to go home. However, every ounce the Lee's gave to prove their innocence in civil court to get the animals out of animal control then something else would happen to the point the animals were held the entire 2 years.
This is the story that lead up the the Lee's raid...................................
Early in 2009, Samantha and her neighbor, Ray Saylor, who is the Milltown town marshal (which is the next county over) got into it over Samantha's horses. This person said he was going to call CPS on Samantha. 12/15/09 CPS visited the Lee home, the Lee's were asked to come to the CPS office on 12/17/09, in which they did, before leaving the caseworker asked them if they'd allow her to open a case on them. The Lee's said no. CPS unsubstantiated the allegations on 12/21/09.
On 1/6/10 the case worker, Shannon Ambrose, then "called in" a welfare child check (on a family with no case). The same neighbor, Ray Saylor, answered the call and went to the Lee's residence. Saylor had been stalking the Lee's for months, the Lee's did not trust him. He told Randell he was at the house to do a welfair child check. Randell got Samantha and told her. Samantha told him he was not allowed in the home. Saylor started arguing with them and they explained they were cleaning the basement where it had flooded, they had moved Josh and Candace both out of their basement bedrooms until they could get the flooding under control, and were cleaning the displaced, waterlogged items and were busy. The family was washing down stuff in the kitchen and they needed to get it finished. Saylor refused to leave and argued with Samantha that he was going to come into the house, that he was there to check for heat. Samantha told him, "look up you can see and smell the fireplace." He then said he needed to check for hot water. Samantha told him that both he and the caseworker knew that she is disabled and REQUIRED aqua therapy daily in order to be mobile. So heat and hot water were essential in the Lee household period. He said he didn't care he needed in the house to check on it. Samantha had to stand outside in the cold for 50 minutes fighting for her right to privacy because this town marshal would not leave, he even threatened to lock up Randell for a joke he said, remember, this is a neighbor and a town marshal of another county who had no warrant. Samantha was on the phone for 20 minutes arguing with the caseworker that they had no right to be there and they were not coming in and the family was busy. The caseworker told her someone was going to get into that house that night if she had to come out herself, Samantha said she had already offered Saylor neighbor to neighbor, to come back in 2-3 hours after they got done what they were doing, he refused that and they were not going to allow him in, they felt he had no right to even be there. The caseworker argued that she'd have someone else to come out, Samantha argued no, they weren't going to stop until they were finished. Samantha who is disabled and cannot be in cold air or talk on the phone long told Ambrose she was then in pain and had to get off the phone and was going in but was not going to let the town marshal in, the caseworker kept arguing and would not let Samantha off the phone. She kept on Samantha asking Samantha to let her open a case on the family, Samantha said no, so she started again on Saylor getting access to the house. Again Samantha said no, this went on for about another 8 minutes. Finally Samantha near tears in pain told the case worker that she can have Saylor come back in 2-3 hours after they got done. Ambrose said no, he was going to get in then. Samantha said no he isn't he can come back in 2-3 hours but I am hanging up. Then the caseworker said "FINE, but you BETTER let him in and he will be there in TWO hours." Samantha told the caseworker the family would have to stop what they were doing to clean up the kitchen floor, take all the dirty items back down to the basement and cram all the cleaned items in the loft, etc. Ambrose also said, that she would be out the next day to discuss opening a case on the family. Samantha handed the phone to Saylor, told him to come back in 2 hours and walked into the house. They didn't go in before because they feared what Saylor would do, they do not trust him, they were warned about his behavior when he moved into the neighborhood. The Lee's who keep to themselves were shocked to have to deal with this. It took Samantha 50 minutes to fight for her right to privacy.
On 1/7/10 Shannon Ambrose said she wasn't coming out because of snow, but asked Samantha if she'd agree to opening a case on the family. Samantha said no. Ambrose said she will discuss it with her when she comes out the following day.
On 1/8/10 Ambrose said she wasn't coming out because she didn't feel well, but asked Samantha again if she'd agree to opening a case on the family. Again, Samantha said no. Ambrose said she'd see her on Monday and would discuss it then.
On 1/11/10 Ambrose came out to the house, was 30 minutes late at that. The reason Samantha let her in is because she was tired of the harassment and wanted to set the record straight with this case worker. Ambrose lied the minute she opened her mouth. Said the school called in a complaint about the kids. Samantha told her "hold it right there, I know you are lying, you had to of called the school. And the reason I know the school would not had called you is because I have an open relationship with that school and the principle because of Josh!" The caseworker never denied and records show the caseworker did call the school. Then when Samantha called her on that, she started in on the cats, saying this cat had feline leukemia, this cat was sick, that cat was sick, that cat was emaciated, just on and on and on. Samantha told her she was a former vet tech, had an animal educational background, and that some of the cats were currently under a vets care and that one cat that was pointed out was not emaciated, that she was long and lanky. Then she started in on Samantha homeschooling Parker. Samantha has followed the Indiana Department of Education laws on homeschooling, the caseworker didn't even know what the laws were and Samantha had to educate her. As the caseworker was getting ready to leave, once again asked if they'd allow her to open a case on them. The Lee's said NO again. The caseworker explained it would be an informal case plan and that she would be able to get them a grant to finish remodeling their home, to get new kitchen cabinets, floor, furnace, etc. Samantha said "we do not agree to an open case, we do not want the states money, we will fund the remodel the way we have been out of our own money". With that the caseworker left. The Lee's felt they finally put things straight with this caseworker.
1/12/10 Per documented CPS records Shannon Ambrose told her supervisor; Dale Stroud and the director of CPS that Samantha and Randell were cat hoarders. With that the director told this caseworker to contact animal control.
1/13/10 Ambrose called Samantha and told her to stay put she was on her way back out to the house, even though Samantha told her she didn't have time to meet with her, Ambrose refused to listen and made Samantha stop to meet with her. Ambrose and Stroud, as well as 2 sheriff deputies arrived at the Lee home. Ambrose told Samantha and Randell they were there to detain the children (without a warrant and without exigent circumstances) and that she called animal control and he would be there shortly. The Lee's were dumbfounded as the last thing either of these parents would do would be harm their children or their pets, both are the world to them. They knew something did not make sense but knew that animal control would set this straight. So when Bruce LaHue, the ACO arrived at the home Samantha spoke with him as he stood in the Lee's living room for 20 minutes commending Samantha on a job well done. He questioned her about a few things just to assure her knowledge. As LaHue went to leave he looked over at the caseworker as though to say goodbye and with that his demeanor changed and he said he would be back the following day to seize all the cats. It did not matter that the animals were under veterinary care just 30 days prior, did not matter that Samantha had proof of that, did not matter that Samantha provided proof of medication the cats were on. Nothing mattered.
1/14/10 The ACO came back and took the cats and coerced Samantha in surrendering Parker's ducks. He said that if she didn't he would just get abuse charges on them also. Samantha felt that wouldn't happen and that surely she'd see a judge and the judge would see their was no reason for them to even be on her property. She just wanted him gone, and not sure of what was going on she surrendered the ducks. LaHue said they can keep the Labrador Retriever, the house chicken and the roosters. As LaHue was leaving he told Samantha and Randell that a bench warrant would be issued and they could see about getting the cats back. However, that has never happened.
In September 2010 AFTER waiting on the bench warrant that the ACO told her and Randell that would be issued, Samantha contacted "Joyce" at the prosecutors office, who claimed to the be the investigator and told her that she wanted the cats back. The investigator told Samantha they were waiting on test results to come back. Samantha told her she knew that was a lie as it does not take 8 months to get test results. Then the "investigator" said they were still being used as evidence against her, but would tell LaHue. The investigator kept on Samantha wanting to know where her horses were, this was 8 months AFTER the seizure, they could not find the horses and were still looking for them.
**Fast forward to evidence provided. The ACO stated in his probable cause affidavit to Judge Roger Davis that he saw a cat in a cage with crusty eyes and had an emaciated appearance. Animal Control's veterinarian said this cat weighed 8.8 pounds and that this cat was considered OVERWEIGHT, he scored a 6 on the Purina Body Scale but yet LaHue under the penalty of perjury to steal these cats, said this cat was emaciated. Since the 2011 raid Samantha has discovered ALL 15 cats he illegally seized he killed on 2/1/10. His excuse....."Mrs. Lee never returned for the cats so they were put to sleep".
2/28/11 Samantha filed a tort claim on the ACO for what he did in 2010. He had a duty to realize the cats in the Lee's care were being taken care of especially providing vetting documentation to him. The tort claim was mailed out to the Harrison County Animal Control, Harrison County Commissioners and Harrison County Council on Feb 28, 2011. It was received by the parties on 3/2/11, the parties had 90 days to respond, no response meant the Lee's had the right to sue. This would had been approximately around June 2, 2011.
The Lee's are not claiming this to be anything related to this story, but it will be added. Sometime during the summer, between June and September the Lee's barn was broken into. Since the prosecutors office was looking for the horses they could not call in the theft done at the barn. Keep in mind to this story, Samantha has a half brother that she no longer spoke to the family. The half brother knew where the property was and knew the horses were there. At that time Samantha knew that her half brother was an Indiana State police officer (or at least she thought he was).
9/22/11 Samantha received a call from a woman, someone she does not know. This woman called 3 times between September 22 and September 24. Samantha was busy and had not had a chance to return the call, but did save the voice mail from 9/24/11. This woman who lived in Paoli Indiana which is not local to Harrison County but not too far away asked Samantha to take cats from the Orange County Humane Society. Samantha did not do so because she was not in a position to help at that given time. This person that called Samantha, the person Samantha does not know is the EXACT person that referred No Kill Louisville to Samantha to help Jeri Warren, that is HOW No Kill Louisville came in contact with Samantha.
10/28/11 the Lee's horses were stolen by the Harrison County Sheriff's department and have been at a rescue since then. Parker the youngest of the Lee's swears up and down LaHue and Saylor are behind this. The sheriff's department stated the horses were at large, however they broke into a locked barn, the fence was cut and told Samantha she would probably be charged with something over the horses, Samantha told the Sheriff she didn't see how since she did not believe that the horses were out but that someone let them out. It was found out later that the Sheriff (same sheriff that was part of the 2010 incident) said the horse rescue cut the fence, the horse rescue told Samantha they were never on her property and that the mounted sheriff patrol brought the horses to the horse rescue. The Prosecutor saw no problem with the horses, just asked the Lee's to make the paddock bigger, however, this was October, the weather was not feasible to move a fence but the Lee's were trying. Not to mention the Lee's had the horses in a smaller area of the 6 acres due to hunters. (In February 2012 the prosecutor asked Samantha to surrender the horses to the horse rescue. Samantha told the attorney that she tried to do that back in November after the raid because with fighting to get the animals back and protect the kids she didn't have time for the horses and the horse rescue refused, but Samantha did surrender them in February 2012. In March the prosecutor asked Samantha to take the horses back. However, the Lee's could not take the horses back because of the raid, they lost the property the horses were and they knew they could not properly care for them with everything they were going through). The horse rescue is now saying the Lee's owe $9000+ on horses that the prosecutor asked the Lee's if they would surrender to the horse rescue so the rescue could adopt out to recoup their losses.
November 5 and 6, 2011 the Lee's took Samantha to Tumbleweed for her birthday dinner. When they came home Ray Saylor was sitting in his truck in front of the Lee's home, when he saw them he sped off. The Lee's did a little more work in the basement that night. November 6 Randell and Samantha ran out to get some errands done and told Josh, Candace and Parker to do their chores and put up their items brought up from the basement. Before they left Samantha had a stomach ache and thought maybe she had food poisoning but still went to get errands done. When Samantha and Randell got home, they helped the kids in the living room to put up more things and then started on the basement work again. Samantha not feeling well helped some, but not as much as before because she was nauseated.
November 7, 2011 Samantha was still not feeling well, it had been over 24 hours and figured maybe it wasn't food poisoning. Not feeling well, she had an appointment for Speck and Gizmo at animal hospital she used to work at. She didn't feel like going but Gizmo needed cosmetic surgery and Samantha did not want to miss the window to get that done. So even though she felt nauseated she drove from Depauw all the way to the East End of Louisville to make sure the cats were seen. Speck had an episode the day before but was fine, she still wanted him examined to make sure. She also wanted to address the ears of these 2 cats. She had been told by her other vets the cats had ear mites, but nothing ever cleared it up, so Samantha wanted a swab test done to confirm this problem was ear mites. The test came back negative, these 2 cats did not have ear mites. Samantha left Gizmo over night for surgery and took Speck home.
November 8, 2011 Samantha was supposed to go back and get Gizmo but she felt so bad she asked for him to stay over night.
November 9, 2011 Samantha went back out to get Gizmo and stopped at another animal hospital in Indiana that she uses to pick up Diamond's Valium for her seizures and discussed with the vet how Diamond had been doing and discussing upcoming blood work on her. She was to take Diamond in for blood work the following week. She went to get Gizmo and went home. Still not feeling well, she did a little here and a little there trying to get things done.
November 12 and 13, 2011 the Lee's were doing more work in the basement. Candace had gone to a friends house for the weekend. Randell and Josh were in the basement moving things to the kitchen while Samantha and Parker were going through them to see what needed tossed and what needed to be saved. Josh was not feeling so great because he had been dealing with the same stomach bug Samantha had. Samantha had gotten over it by the 12th and was back on task, and now Josh was doing things here and there like she was. Moving things out of the basement on weekends had been a regular occurrence in the Lee home since around October 20, 2011. Josh had been forced to make a bedroom in the living room because they had had enough of the turmoil and disruption of their lives over the drainage problem that they thought was fixed and/or under control. They were at this point trying to empty out the basement without completely having everything dumped on the two upper floors, they were trying to avoid constant clutter and trying to control the clutter by doing it at a pace, brought up on weekends, put up during the week, then start over. All while trying to provide normalcy for the kids and to have the house back to normal for Thanksgiving.
November 14, 2011 Josh woke Samantha up at 6 am and asked her to take him to the ER. With this bug you'd feel ok, minor discomfort but every time you moved you'd feel like you were going to vomit, so it was hard trying to do anything. This was his 6th day and Samantha told him hers lasted 6 days and he should just sleep it off, he'd feel better in a little while. He tried that, but came back and insisted he wanted to find out what was going on. Samantha knew she was going to take Kenya to the vet and told Josh she felt he'd be fine but if he really insisted she'd go ahead and take him and take Kenya later. So Samantha took him to the ER. There Josh did vomit, and was diagnosed with a stomach virus and was sent home. Samantha went home to get Kenya, her appointment was at 2 pm. She tried to get Kenya in earlier but the vet was not on the premises until 2 pm. Kenya had slight mouth breathing the night before. Samantha monitored through the night. She did not have any eye drainage or nose drainage, which are signs up an upper respiratory infection. Samantha thought it was odd, she was just exhibiting slight mouth breathing. Monday morning, Kenya was in the same condition, but Samantha was concerned. The vet looked Kenya over, did some blood work and diagnosed her with a URI. She was put on Clavamox and sent home. Samantha that night had a house to get back into shape and 2 patients to take care of. Josh was laying around, he was still nauseated, but was feeling better. Samantha put Kenya in quarantine and got her set up for the night. Samantha then did some things around the house. She had Parker do his chores which was clean out the litter boxes on the main floor, dump, wash, sterilize and refill. Candace was supposed to do her chores and refused to do so. Samantha has a 3 day window before initiating punishment, this is to teach the kids cause and affect. Samantha did ask Parker to go ahead and pick up the kitchen of things out of place. Since that is Candace's job Parker expressed to his mother that was not fair because he did his chores Candace and Josh should do theirs. Samantha agreed with him. Josh did a few of his, but it was understandable he still had some nausea. Samantha's views on disobedient children (well hers) is they will never learn as long as she does what they don't want to do. Her kids would rather have everything take away than to do chores, these kids will tell you that. When they want something however they work their butts off, so they have shown they know what needs done and how to do it. So Samantha fussed at Candace, told her to do her chores, her reply was NOPE, so Samantha let it be. Time was ticking away on Candace getting grounded.
November 15, 2011 Since Josh had a catering event on the 16th, Randell had suggested that Samantha run errands instead of coming home (to save gas). Samantha wanted to come home and clean and go back and get Josh, this is the norm for Samantha. But Samantha had errands that really needed to be done so she decided she would. In order to do this, Samantha needed to "precouperate" to prepare. Samantha was feeling better physically with her RSD but knew she still had to watch how much activity she could do. So she rested from about 7 pm on. She gave the kids a list of things she wanted done. One of the main things is Samantha told Josh to go to the basement and bring up any and all dishes he had and wash them. Josh's idea of that was to bring up the dishes and put them in the sink and leave them. Samantha not knowing she had to hoover over kids aged 19 and 17 trusted them to do their chores, well they didn't. And Samantha did not realize until the next morning.
November 16, 2011 Samantha waited for the vet to call about Kenya's blood work. Jeri Warren called Samantha 8 times between 8 am and 11 or 12 pm, we will go into that conversation down below. Samantha did not want to tie up the phone line if the vet called so did not called Warren back until after she spoke to the vet. When the vet did call she asked how Kenya was doing, Samantha told her she was doing better but had not bounced back as quickly as she felt she should had. She was not eating still, and that Samantha was hand feeding her a gruell and some canned food. The vet said she'd like to add another antibiotic, Samantha said ok. Samantha then discussed the other cats with her. Samantha told her that Chargheera and Mufasa had started with signs of an upper respiratory infection, could the vet give them a bottle of Clavamox. The vet said "legally I cannot do that but I can order a refill for Kenya and ok you to give it to them." Samantha said that would be fine, "what do I do about all the other cats? Most likely they will start with it too and I don't want them all getting it." The vet told Samantha "I suggested you put them on L Lysine, it will help ward it off. I don't have any in stock but can order you a bottle, it's kind of pricey though." Samantha ordered the L Lysine, told her she'd come pick up the meds for Kenya and the other cats in a couple of hours. Samantha then called Jeri Warren back, and told her she never said she'd be there at 7 am that she told her after 4 pm. Samantha left to pick Josh up at school, went to the vets office and got a bottle of Clavamox, a bottle of Zeniquin and 2 cans of food for Kenya the vet suggested. She also asked the tech if she knew of any maintained feral colonies as she needed to pick up 2 feral cats and needed someone to take them. The tech gave her the number of Floyd County animal shelter and a private number. It was written down on a yellow post it. Samantha left there, dropped Josh off then headed to Louisville to get Jeri Warrens cats.
The message left by Jeri Warren......
Jeri Warren started at 8 am calling and yelling at Samantha "WHERE ARE YOU, YOU SAID YOU'D BE HERE AT 7", "WHERE ARE YOU ARE YOU COMING TO GET THESE CATS?" Just on and on and on and on, very rude, very hateful, and very panicky. Samantha was put off and could not understand why she thought she'd be there at 7 am when she never said that, why she was in such a hurry to get Samantha there to get the cats, why she felt the need to call 8 times. After speaking with the vet Samantha told her that she'd be there after 4 pm, not before that.
The visit with Jeri Warren.........
Samantha went to get 2 feral cats from a lady begging her for help (this lady was referred to Samantha, Samantha did not seek this person out like the ACO has tried to make the public believe). It was put to No Kill Louisville, that if this woman did not rehome these 7 cats that she would be evicted. You can read the emails between No Kill Louisville and Samantha. They contacted Samantha. Samantha is a very compassionate person and tries to help people, since the cats were feral she said she would help because the cats would not be part of Frisky Felines Foundation as Samantha told this woman she was full and could not take anymore inside, but would help her since they weren't coming to the rescue and would put them with a feral colony. The goal Samantha was trying to achieve was to keep this woman in her home.
Samantha felt sorry for this woman who seemed upset having to rehome these cats. There was a mom and 6 6 month old kittens. Jeri had told Samantha her neighed was shooting at them. Samantha offered to go and speak with the neighbor that there are feral cat laws, Jeri said no. Samantha said she could mail paperwork regarding such to him, Jeri said no to send it to her and she would tell him. Samantha offered to build her a feral cat housing behind her trailer (her trailer backs up against the woods, no other homes behind her), Jeri said she could not afford that. Samantha offered to pay for it all, Jeri said her landlord would not go with that. Samantha said she'd be willing to talk to him to see if he would, the situation was put to Samantha that the cats were wondering around and that bothered this neighbor that was shooting them. Samantha then offered to house the cats at her property and give her time to find cat friendly property to move to to have these cats. Jeri said "no I want you to keep them." Samantha told Jeri, "I'm not keeping them, they are going to a maintained feral colony, I just don't have the time needed to work with these guys so I will find someone that can so they aren't being shot at and you won't lose your home." So with that, they transferred the cats to Samantha's carrier and Samantha left.
November 17, 2011 about noon the sheriff's department was on the Lee's porch. It was guess who....Ray Saylor, the same town marshal that Samantha had gotten into it over the horses. He was with another deputy, who happened to be part of the 2010 seizure of the Lee's cats also. So we have Ray Saylor, part of the 2010 CPS case, Deputy Asher, who took the horses in 2011, who was part of the CPS case in 2010 and Deputy Gilley who was part of the cat seizure in 2010. The Lee's live in a small county, but not THAT small! Needless to say, out of fear they refused to answer the door. Randell and Samantha will NOT open their door to Ray Saylor EVER again! So they waited for them to leave, they never did. They staked out the Lee's home until they got a warrant to enter.
First Saylor and Gilley were at the residence, when the Lee's refused to answer they walked around the house. Around 2 pm they called in LaHue. LaHue came, knocked and Lee's refused to answer the door, they waited for them to leave. They decided to walk around the yard, knock on the back door and walk around some more. There were 2 dogs in the back yard. Brownie who is a Chocolate Lab, who is a full time outside dog, they had tried to make her an inside dog, but she just would have nothing of it. The other dog was Coal a Black Lab, who was not their dog. He belonged to another rescue who dumped him on the Lee's when they said they were going to go come back and get him. He came with another lab who Samantha did rehome. Coal and Brownie were out back, Coal is a great indoor dog but he prefers to be outside with another dog. Samantha had put Bindie outside in her training crate so she could clean the house and put Coal in one of the kennels so not to have to tie him anywhere. Samantha saw LaHue and Saylor take these 2 dogs about 2:30 pm. She thought how odd, they took the 2 dogs and never issued a warrant. That is because they claim that Coal was, let me put this how LaHue said it "could see his spine and ribs from a distance.....was told to do whatever necessary...." He seized BOTH the dogs with an exigent warrant based on fabricated statements without any proof whatsoever. The photo of Coal PROVES you could not see his spine and ribs from a distance. See Coal's page for Coals photo, the report, etc. They then got a warrant to get into the house.
NOTHING was ever stated as to as to why the ACO seized ALL the pets on the property, except that Jeri Warren had a complaint on the condition of the house. Samantha never gave her the address of the house. Jeri Warren said the Better Business Bureau googled the address and gave it to Warren. Later there were 2 different reports, 1 was the above, the other was that Warren reported the cats stolen by Samantha. Gilley says Warren says Samantha stole them, Saylor says she complained about the house. See the depositions for these statements.
In addition to this the Lee's were not allowed to see the warrant UNTIL AFTER all the animals were removed out of the house( they asked 3 times)
The Lee home was a mess, something Samantha has never denied, BUT the house was a mess for VERY good reasons and I will state those here for you to clear up any rumors you may have heard or will hear.....
CONTROLLED CHAOS
In September the basement flooded, had 8 inches of water in it, then the sump pump broke and what water they could get out just came right back in. The Lee's went to get another sump pump and they could not get the type needed for their basement. Eventually they did get the correct sump pump but things had gotten worse in the basement to the point that the beginning of October Samantha and Randell MADE their nearly 19 year old son move out of his basement bedroom until they could get all the water logged items outside and burned/tossed. Which was a task in itself. It has been reported that Samantha and Randell made their 17 year old daughter, another report says minor child sleep in this water logged room as late as November, the ACO made the statement that Parker had been sleeping in the basement, however, none of that is true, that is why the basement looked the way it did, NO ONE was using the basement since the first week of October, it was being emptied out due to the mildew, everything was water logged and was going to be burned, but you can't burn wet things nor is it safe to walk on the floor with water because of the cement. This is an UNFINISHED basement. It has a concrete floor and concrete walls.
Josh (who is the oldest child) moved to the living room. Josh is a typical teen age boy and is not the cleanest unless he wants something from his parents then he is amazingly neat. Which Samantha and Randell feel is a typical kid. From moving Josh to the living room the living room then became smaller, crowded and consisted of things the living room didn't have before which all belonged to Josh. In order to get Josh's "bedroom" in the living room Samantha had to take down her office and turn it into a sitting room to house the living room furniture, so Samantha had to condense the office (which is upstairs in the loft) to another part of the house. This meant purging items and getting rid of things that they no longer wanted, etc. They had to move holiday decorations around to utilize attic space better which is why Halloween things were out.
Josh also asked Samantha if he could take over the kitchen (he wanted to be a chef), Samantha knew not to do that, but Josh promised to keep up with it all and keep it clean. So the living room and 1/2 of the kitchen was then Josh's responsibility. With this, Josh as a typical teen enjoyed making the mess when cooking but never wanted to clean up afterward and Samantha like a typical mother had to get on him over and over.
On Nov 10, 2011 (Thursday) feeling a little better Samantha started cleaning some more. Candace was cleaning their bathroom and their bathroom walls had mildew on it (not mold as the media reported) and Candace was wiping the walls down (the mildew was on the glue from where they took the wall paper off in order to paint the walls. The mildew came not from lack of ventilation as stated in reports but due to the door being shut after showers and the fan for the vent not being turned on, it was also reported this bathroom had no ventilation and it does.) Samantha told Candace to stop wiping the walls down until she went to to the store to get facemasks. (There is a photo where you can see the wall was being wiped down), but these parents are being charged for having mildew on the bathroom walls because Samantha halted cleaning that until face masks were available, they'd rather the family clean it than take safety precautions.
On Nov 12, 2011 (Saturday) The family was trying to get everything washed up and stored away. There were clothes hampers of stuffed animals brought up, Josh's items out of his room, the stored canned goods, the furniture that still needed to be moved upstairs, etc. All of the items being brought up from the basement were placed in the living room and in the kitchen. Some of Josh's items were on the living room chairs. The items that were ready to be thrown in the washer (that they were trying to save) were on the kitchen floor across from where the washer is, which consisted of a dog bed, a pillow case and a rag all from the basement, a jacket and pair of shorts there were other items in clothes hampers that were to be washed in the washer and other various things needing somewhere to go were setting out. Josh was still feeling off and was not helping as much due to feeling nauseated and Candace was not home to help, so it was just really Samantha and Parker.
On Nov 13, 2011 (Sunday) was rolled over cleaning from Saturday. Josh was still feeling off and on with not feeling well. The family kept going through things. Kept on the same routine of getting ready for Thanksgiving. They brought more things up to be washed in the bathroom, some of it was on the floor, etc. Samantha did not mop the kitchen floor, living room floor, or the kids bathroom floor because they never got finished and was waiting to mop once that part of what they were doing was finished. Kenya, an adoption cat started acted odd and Samantha had planned on taking her to the vet the following day.
Nov 16, 2011 (Wednesday) Samantha got home and discovered Candace and Parker did not do their chores. This made Samantha mad as there was so much that needed done by Friday night. Samantha did not want to wake Candace because of school, so she punished them instead of doing their chores for them, she left them to do the next day after school with additional chores. If it wasn't holiday coming up she would had grounded them from their friends like she normally does.
Nov 17, 2011 (Thursday) Samantha got up to get a head start on getting the house back in order and since she punished Candace and Parker she was trying to get her chores out of the way so she could help the kids get the house back in order, Samantha and Randell soon learned they were being staked out.
The State Vet.....
Now, keep in mind the raid was on 11/17/11, the state vet did not see any of the animals until 11/21/11.
The state vet reports that 21 cats scored a 1-2 on the bcs, which says they were emaciated with bones visible. There are only 2 determinations regarding that report since the Lee's had a few overweight cats. How can NO cat on the bcs not score a 6 if they were overweight??? The state vet said, when she examined the cats that NONE of the cats were of average weight. You can look at the photos during the raid and the intake photos and the photos do not match the report by Dr. Jody Lovejoy who claims all the cats were either underweight or emaciated. So either she is lying or the aco starved the cats to get low body condition scores, or worse to make them die. I had cats at the vet on 11/14/11, 11/8/11, 11/7/11, and 5 on 10/13/11. The only cat that was underweight was Kenya, the cat with a URI. 5 cats were spayed/neutered on 10/13/11, 1 cat had surgery on 11/8/11, so how can these cats go from good body weights all the way down to a 1? This ALSO includes Jeri Warrens cats, her female cat scored a 3. The cat was in the Lee's care less than 24 hours!
It is rumored that there was feces all over the floors, on the kids beds, on the table, counters, etc. That is a lie, yes, there was SOME feces in the house, it was generalized by the back door which was by a litter box and another litter box. A couple of cats were being treated for coccidea and had loose stools. The aco and the cops both testified that "these cats had it coming out of both ends", and that is a lie. ( Actually this is the same statement stated in the paperwork in the 2010 illegal seizure.) They say the poo was old and that is a lie also, before Samantha went to bed the night before she checked the by the litter boxes because she wanted to make sure the litter boxes didn't need to be scooped before going to bed, because if they did the cats may go outside of the boxes before she got up in the morning. Maintaining the litter boxes is a paid job of Parker's. There was some poo in the boxes but not very much, there was enough room and fresh litter available in the boxes. They are saying the litter boxes weren't touched in weeks or months, however, Parker just washed, sanitized and refilled the litter boxes that Monday evening, you can see the fresh litter in the photos. The reason there was feces there is because the Lee's were staked out for 5 hours and no one could not tend to the main floor at all. Samantha laid down at 11 pm, got up around 10 am, she started working on the upstairs litter boxes so she could get her chores out of the way to be able to help Candace and Josh when they got home from school and to help Parker once he started doing the main floor. So for a total of 18 hours the litter boxes were not tended to. Not to mention when the "authority" came in the house they didn't "walk" through the house, they were skipping around, flying about like they were giddy children. Even knocked over a large dog waterer. The cats were freaking out and the Lee's have never seen their cats act like that. First the cats were all calm, laying around, but then started running about the house. It was really sad to not be able to comfort them, most of them knew what was going on. The floors were marked up from tracking the water from the basement throughout the house and coming in and out of the back door not from feces.
That pretty much describes what happened. Was the house a mess?, Yes. Would a simple, clean it up suffice? Yes. Were the animals generally in good health? Yes. Was veterinary care provided? Yes. Did anything warrant a seizure? No! As a matter of fact the house was cleaned within 24 hours. The rest of the time was spent trying to protect the kids and cats.
The ACO is out to destroy Samantha and has already defamed her on TV and to the news papers, why? Is it because she filed a complaint and now it may be found out what he has done and possibly is doing to other people and how for no reason he is killing HEALTHY animals that STILL LEGALLY belong to people? Does he want to give her such a bad name that no one will believe her once she speaks the truth to the community of how he is hurting innocent animals? Is it because she is standing up for her family's civil rights? When asked what his job consists of he stated and I quote "seizures, impounds and helping the sheriffs department build criminal cases." Really? Since when does an ACO's job consist of seizures and helping build criminal cases? What happened to issuing citations/warnings that is LISTED in the Harrison County Ordinance?
The Charges.........
2 cats died, 2 were euthanized.
Pumpkin an 8 week old kitten died on 11/26/11, the Lee's believe they know why, but cannot say yet.
Sagwa, Parker's cat was euthanized on 11/28/11, the Lee's believe they know why, but the animal control vet said she was euthanized because animal control could not afford to vet her after she had a seizure in their care. Seriously?? When Diamond had a seizure in Samantha's care, Samantha took her to the vet, Diamond was put in the hospital for 2 days, had blood work done, etc. Samantha paid for it.
Garfield, Parkers cat was euthanized on 11/29/11 due to being depressed, lethargic and sick. The Lee's know why he got sick, however, the aco's vet said he was euthanized because animal control could not afford his care.
Abbigayle died on 12/14/11 after being starved to death for 8 days. Animal control knew this and documented this, but never provided any vet care for Abbigayles anorexia.
These 4 cats are the charges that the Lee's are facing, charges for something they did not do, had these cats been in the Lee's care, they would had been vetted and alive today. Do you really believe the $7000 vet bill came from vetting these healthy cats or from the $300 an hour the animal control vet charges to look at 36 cats, 3 dogs and 4 chickens???
These people behind this illegal seizure need to be fired and put in jail for child and animal abuse as the accusers are the abusers.

"We had been raising money for the animals attorney since 2012 and 2013, thank you to those that helped, we lost, but I won't stop fighting. We spent over $10,000 trying to save the animals. Within 2 years 6 cats and our rooster died. Since 2010 we lost 25 animals. I will not stop rescue but I will take on a new organization to stop this cruelty to rescues and pet owners and stop these people raking in money off the backs of our animals and killing our animals out of spite or retaliation.
We still need help, not to save the animals now, but we need people to know my husband and I are innocent, we want things like this stopped. So what do you get out of helping me?? Well, for one, I am mad as heck and I will be lobbying for new laws, yeah, everyone says that will never happen, that is probably what they said about Amber's Law, etc. I will fight for it until it happens. Secondly, IF we win this lawsuit for what we are asking we will be putting up a fund to help those wrongly affected by CPS, Animal Control, or the liking to be able to fight back and sue. In my opinion that is what is wrong with this country, no one can financially fight it or they are too scared due to retaliation, I mean, seriously, I stood my ground, now I am facing criminal charges because of it.
