THE CHARGES
On 12/19/11 we were charged with neglect of a dependent and neglect of the cats. The charges on the cats came from LaHue saying "despite aggressive treatment" the cats died (will post actual statement) Below is the the actual charges. Both were the same for Randell as well as Samantha
There is NO evidence of mold growing in multiple rooms, rotting or moldy food found in multiple rooms, feline feces or urine covered the floors in multiple rooms or where live electrical cords were in or near water next to a bed where 1 or both juvenile children had recently slept.
During the trial....
there was no mold shown, nothing to provide evidence anything was mold.
no mold or rotting food was shown
Only floors shown were the kitchen floor, part of the main floor bathroom and part of the master bedroom floor. The photo of the kitchen was the high traffic arear that was tracked up with dirt and sludge. As a matter of fact, the area they focused on was the area between the basement door and the back door. The floor needed mopped but it was the area of which we were dragging things up out of the basement to either toss or clean up. The other area was the bathroom floor where they kept saying chicken feed was feces. I don't know any cats that have seeds in their feces.
Nothing was shown of any live electrical cords in or near water next to a bed where either the 14 year old or the 17 year old slept. The bedrooms of each child was shown, the only electrical cords were Christmas lights, these bedrooms are on the main floor and there was no standing water, Deputy Gilley was asked to point out where their was water next to Candace and Parkers beds. He SAID... their bedrooms were on the main floor, the water was in the basement. Which clearly proves the charges were on the basement, of which no one slept in for over a month, which was Josh's bedroom. Deputy Gilley also said he didn't know until the week of the trial a third child lived in the home, however, Ray Saylor, who is our neighbor did know this.

During the trial, the aco and the vets all said the cats were emaciated and in ill health in this photo...
As a matter of fact the aco said the coats on these cats was not shiny it was appearing that way because of the flash from the camera.

These charges are on Pumpkin, Sagwa, Garfield and Abbigayle. It was proven in court that the aco withheld medication AND vet care
This is Pumpkin AFTER 5:30 PM on 11/17/11, the day of the raid. As you can see, she had started with symptoms of an upper respiratory infection. I was given Clavamox by my vet (after I asked) for medication for Chargheera and Mufasa, the vet said I could use it on ANY cat starting with signs of a URI. This was TOLD to the aco assistant to give the Clavamox to ANY cat that had started with signs and that my vet also suggested I start all of them on L Lysine, it was on backorder, I ordered it. This was NOT done. Pumpkin was not given my medication. Dr. Smith ordered Orbax, an antibiotic for her URI on 11/18/11. NO ONE at animal control picked up the medication until 11/21/11, the medication was NOT given until 11/22/11. We were charged for failure to provide veterinary care.
She was reported "found dead in cage" on 11/26/11. According to the record, she WAS medicated the day she died, so my question is, she was medicated that day, obviously was not "dying" but died after being medicated?
During the trial they did not have any intake photos of Pumpkin, they also have NO weight on Pumpkin on 11/17/11 upon intake, NO weight upon alleged exam by Dr. Smith on 11/18/11, NO weight upon allegedly exam by Dr. Lovejoy on 11/21/11. ONLY thing record to give any type of weight is the body condition score. However, she was started on medication on 11/22/11, but still no record of her EVER being weighed. Their stories changed from "don't know who wrote down weights or where they are recorded" to "the scale broke", but yet, you must have a weight to start medication..........

Pumpkin scored a 1 on the Body Condition Scale on 11/21/11 by Dr. Lovejoy
This is Sagwa after 5:30 pm on 11/17/11 the day of the raid. As you can see she was not sick. Per my vets instructions however, just as I told animal control she along the other cats needed to be on L Lysine. There is no weight for Sagwa upon intake on 11/17/11, being allegedly examined by Dr. Smith on 11/18/11, being allegedly examined by Dr. Lovejoy on 11/21/11 nor even when she was euthanized on 11/28/11.
Missy Graham, who is the person in charge of medical at animal control called Dr. Smith and was told if Sagwa continued to seize for 30 minutes to euthanize her. Dr. Smith's office is maybe 10 minutes away from animal control. Animal Control or Dr. Smith had time to get to Sagwa to give her valium to stop her seizure. Sagwa never had a seizure before animal control got her.
The photo below is Sagwa allegedly the FOLLOWING day during the exam by Dr. Smith

Sagwa had a seizure on 11/28/11 while in animal controls care, they watched her seize for 30 minutes, refused to provide her with vet care then euthanized her. We were charged with failure to provide vet care.

This is Garfield, in the window was about 2 pm, the one below that was after 5:30 PM day of the raid. Look at his right eye and the back half of his back towards his tail
The next 2 photos are taken when allegedly examined by Dr. Smith on 11/18/11, compare the right eye from the above photos and these photos and the fur that looks like it had been shaved. Notice how roughed up he looks in their care vs our care.
There are no weights recorded for Garfield on 11/17/11 upon intake, on 11/18/11 when alledgely examined by Dr. Smith, on 11/21/11 when allegedly examined by Dr. Lovejoy. Garfield was started on medication, but was never weighed.
Animal control was told that all the cats were to get Clavmox if they started showing symptoms of an upper respiratory infection, if no signs were supposed to be put on L Lysine to ward it off. Garfield was withheld both the Clavamox and the L Lysine, in addition to the medication that Dr. Smith ordered on 11/18/11. His first does of antibiotics was given on 11/22/11.
It is reported that on 11/29/11 he had matted shut eyes, labored breathing, blood tinged pus from his mouth. He was refused vet care and was euthanized. We were charged with failure to provide vet care.

This is Abbigayle on 11/17/11 during the raid, I do not have the intake photo of her just yet but when I get it I will post it.
This is Abbigayle after 5:30 PM 11/17/11, the day of the raid. As you can tell by her face, she is not sick. There is no weight for Abbigayle upon intake on 11/17/11, nor when allegedly examined by Dr. Smith on 11/18/11, nor when allegedly examined by Dr. Lovejoy on 11/21/11. She was not given the medication I provided to animal control nor the L Lysine my vet suggested they be put on. Abbigayle was put on antibiotics because I guess she started at some point with the URI, but yet not weighed.
Abbigayle ended up with anorexia. On 12/5/11 she apparently stopped eating. From 12/5/11 through 12/13/11 they did not vet her for her lack of appetite. They noted her chart however that she was not eating, was losing weight (however, no intake weight was EVER recorded, so they had no idea how much weight she was losing). On 12/13/11 they note she was cold to the touch, still refused to vet her, she died overnight or the morning of 12/14/11. We were charged with failure to provide vet care.
Below is the actual form of Abbigayle which was used to get charges against Randell and Samantha
