HARRISON COUNTY, Ind. (WHAS11) – Two children are taken from their mother after authorities find sick animals on her property in southern Indiana. Officials say she is an animal hoarder who was posing as a person who runs an animal rescue shelter.
Animal Control Officer Bruce LaHue found dozens of cats at a home in Harrison County with eye infections, open sores and other medical issues. He says the owner of the house was posing as the director of an animal rescue shelter.
Jerri Warren was looking for a safe place for seven stray cats she had taken care of for six months when she came across this woman. Jerri had placed an advertisement on MySpace and the woman contacted her.
"I'm thinking she's legit, she looks legit and sounds legit,” said Warren.
Warren met the woman and gave her the cats. Later that night she called to check on the cats, but did not get an answer. After not getting an answer the next morning either, she decided to track the woman down and go to her house.
"I was really upset. When I saw the house I started to cry. I ran and called police. I was really upset,” said Warren.
Officials showed up and said the smell of urine and feces was overwhelming. At the end of the day, they took 36 cats, four chickens and three dogs from the house. Child Protective Services also took custody of the woman's two children.
"In my experience it's one of the worst cases I've seen in terms of the conditions and the number of animals being kept,” said LaHue.
The woman is under investigation and both Bruce and Jerri hope she will not be allowed to do this again.
Last year, 21 animals were seized from her house and many had to be euthanized. Her kids were taken then too, but criminal charges were not filed. This time, however, criminal charges could be filed once the investigation is complete.
The TRUTH to the statements above:
The children ages 14 and 17 were not taken from their mother.
Authorities did find a few sick cats on the property (in the house) HOWEVER, they were under a veterinarians care as of Nov. 16, 2011
Samantha Lee is NOT a hoarder and is a full fledged, home based rescue that was in the beginning stages of building a facility for the cats.
LaHue did NOT find dozens of cats in the home that had eye infections, open sores and other medical issues. The cats that had a Upper Respiratory Infection (which is common in multi cat household and in rescues), was and in chronological order: Kenya (started with symptoms of a URI on 11-13-11/vetted 11-14-11), Chargheera (started with symptoms of a URI on 11-15-11/vetted over the phone on 11-16-11), Mufasa (started with symptoms of a URI on 11-16-11/vetted over the phone on 11-16-11). Samantha asked the same vet what to do for the rest of the cats if they should start to come down with it as well. The vet SUGGESTED something to Samantha that should could be bought through that office, however they were out of stock. Samantha ordered it, it came in the day after the raid. Samantha was directed by her veterinarian to provide Product A to any cat that starts to show signs of an URI until Product B came in. Samantha did that. As of 11:30 am on 11/17/11, Kenya, Chargheera and Mufasa were the ONLY cats exhibiting any sign of a URI. The house was staked out about noon or 12:30 until 5:30 pm, Samantha was not able to tend to any animals needs from noon on (approx 9:30 PM). At about 6 pm there were 4 kittens that had come down with symptoms of a URI only showing symptoms of eye drainage, 1 cat had 1 eye that was draining but could had been from anything, from them chasing the cats around the house, they were freaking out and were scared to death and have never acted like that before and her eye was not goopy, another cat had the same situation, 1 eye, slight drainage, not goopy. 1 cat had a large scratch on her neck and it was healing from where it was being treated, 2 other cats had flea allergy dermatitis from flea preventive that just did not work on them. They were on flea prevention for a full 6 weeks before the raid, 3 different types per the vets suggestion, the final one what what was working. Samantha gave animal control nearly $100 worth of medication for the cats the night of the raid to ENSURE, the URI would not spread to the other cats, that the cats that needed their medication got it to prevent the URI from getting worse and Samantha told animal control that the vet said all the cats needed to be on Product B.
Jerri Warren did not place an ad on My Space. No Kill Louisville had posted the ad on Facebook and someone had referred Samantha.
The smell of urine and feces was overwhelming? The fact that the Lee's were cleaning a flooded basement and purging things in their house is proof enough of the lies. The fact that the Lee's had a flooded basement and that is what caused the messy house is proof enough. The fact an ammonia test was done and it came back extremely low is proof enough.
CPS did NOT take the children, they stayed with a friend for a few days, mainly so Samantha could work on getting a lawyer on the case to save the animals. They children did not need the stress of what was going down. Samantha and Randell knew EXACTLY what was going to happen because they put it in the tort claim that they filed against LaHue that he would retaliate against them for filing it earlier that year.
Last year is January 14, 2010, 15 cats were taken and Samantha was coerced to surrendered Parker's ducks. ALL the cats were murdered but the ducks were adopted out, in a court of law LaHue said the reason the cats were killed is "because Mrs. Lee never came back for them." Which is not the truth because Samantha was told by LaHue a bench warrant would be issued for her arrest and THEN she could see a judge about getting the cats back!!!!!!

Owner Of No-Kill Shelter Facing Cruelty, Endangerment Charges
HARRISON COUNTY, Ind. - The owner of a no-kill cat shelter is facing charges of animal cruelty and endangering her children.
Samantha Sue Lee, 44, and her husband 45-year-old Randall Lee turned themselves into police this week after animal control searched their home in rural Harrison County and issued arrest warrants for both of them.
"It's very, very sad," said neighbor Adelma Baize.
Baize said what animal control found inside her neighbors' home on Milltown-Frenchtown Road confirmed what she has known for years.
"They don't care," she said. "They don't treat them right."
Samantha and Randall Lee each face four counts of cruelty to an animal and one count of neglect of a dependent after authorities searched the home in November.
"As soon as you walked in the home, the smell from my understanding was just absolutely disgusting," said Otto Schalk, Harrison County prosecutor.
Schalk said animal control acted on a woman's tip after she dropped some cats off at their home.
According to Samantha Lee's website, their home is used as the "Frisky Felines Foundation," a no-kill shelter tending to cats that need help.
"They saw fecal matter all over the floor and black mold covering the walls," Schalk said.
According to Schalk and a probable cause affidavit, 34 cats lived inside the home without adequate food and water.
Schalk said many cats were sick and so far, four of them have died.
What's worse, he said, is the couple's two kids, both teens, were living there too.
"There's several pictures we have of fecal matter on top of beds, fecal matter on the floor next to the beds," he said. "It's certainly no way for a child to have to live."
In the affidavit, cops said outside the home, dogs and chickens were found without food.
Some of the animals were also in cages that were too small and they were covered in feces.
Neighbors said they hoped the charges would shut the home shelter down.
"They should never be allowed to have another animal," Baize said. "never."
The couple did bond out of jail, according to Schalk.
He said their home then had to meet health codes from the Department of Children and Family Services and the Health Department before the kids could stay there again.
WLKY tried reaching the Lees both by phone and at their home for comment on this story, but were unsuccessful.
Schalk said animals taken from the home are currently in the care of Harrison County Animal Control.
The neglect of a dependent charge is a class D felony.
The animal cruelty charges are class A misdemeanors.

THIS IS OUR RESPONSE..............
Baize said what animal control found inside her neighbors' home on Milltown-Frenchtown Road confirmed what she has known for years.
They don't care they don't treat them right.
Lees response: Aldema Baize and her husband have not liked the Lee's since the fight over the property line after the Baize's moved in and decided to take over 3 feet of the Lee's property. The Baize's own very vicious dogs that try to lunge through the fence at the humans and dogs that are in the Lee's property. The Lee's cannot safely do anything along the fence line due to these dogs. Baize's dogs have nipped the noses of the Lee's dogs on at least 2 occasions. The Baizes have had a limping cat for over a year. The Baize's have many, many different cats that just end up disappearing. The Lee's cats Sofie was last seen on 7/9/11 going into their yard, Sofie has not been seen since. The Baize's after that offered to fix the Lee's cars, offered to help them with this or that, loan them things, when for years before they never spoke anything but hatred to the Lee's, now all of the sudden after Sofie disappeared they are nice? The Lee's animals are treated well, the Lee's even bring in the chickens and ducks and dogs during tornadoes and really bad storms and even snow.
Schalk said animal control acted on a woman's tip after she dropped some cats off at their home.
Lee's response: Otto Schalk is the Harrison County prosecutor and has just been caught lying and defaming the Lee's or have not even bothered to look at any of the photos and have NEVER asked the Lee's any of this.
Lee's response: Jeri Warren DID NOT drop her cats off at the home, she told Samantha Lee she could not afford to drive to Indiana and she couldn't afford to feed her cats, she had to borrow food from her neighbor WEEKLY and go to a pet pantry. Samantha Lee drove to Louisville to help this lady avoid losing her home because of these feral cats. IF someone that supposedly loves their cats so much but have such a negative response of the shelter, why would they leave the cats and then call the cops?

Lee's Response: The cats had a BRAND NEW bag of cat food that was purchased the MORNING of 11/17/11. The cats had a self waterer that Bruce LaHue hit the waterer and caused it to fall over, you can see the photos of it before he hit it and after. Diamond was on wet food and Kenya was temporarily on prescription diet wet food from her veterinarian. The Lee's have pix to prove these cats were fed as well as receipts for food purchased.

_Otto Schalk... "There's several pictures we have of fecal matter on top of beds, fecal matter on the floor next to the beds"
Lee's response. Pictures show ONLY 3 beds,
Master bedroom is the bed with the red comforter.
The 17 year olds bed is the one with the purple comforter NO PHOTO TO BE FOUND OF THIS BED
The 14 year olds bed is the one with all the stuffed animals
The 19 year olds bed is the one with a white blanket. This bed is in the basement and has not been used since around October 1, 2011 due to the basement flooding. No one has been in the basement since around Sept 30 except to bring items upstairs and to clean and empty out the basement from the water.
NONE of these beds had feces on them and you can see in the photos.
NONE of these beds had feces on the floor around them.
And do you see cats that are emaciated?

This is Parkers bed. The sheriff lied in the probable cause affidavit and said Parker had no blankets to cover up with the he had only stuffed animals on his bed and had to use those as blankets. As a matter of fact, on Parkers bed is an electric blanket, a light weight blanket and that purple and orange sleeping bag that he prefers sleeping with. So why would the police report say that this child slept in the basement, but they have a photo of his bed. Them saying this child slept in the basement is why the Lee's are being charged.
This is my 19 year old sons bed in the flooded out basement. This is what the Lee's criminal charges of neglect of a dependent are on, HIM!!!! My son, a typical male teen, was told "clean up your room", well that is as far as it got Tuesday evening (2 days before the raid). NO ONE has used this bed, or this room since the first week of October 2011 because of the flooding. I moved him to the main floor to avoid him getting sick, and well, this mess moved upstairs...... Anyway, again, another bed with no feces.
_Otto Schalk ..."Some of the animals were also in cages that were too small and they were covered in feces."
Lee's reponse: There were 5 felines in a cage, 1 dog in a cage, 4 chickens in cages
Bindie....Dalmador
Kenya...Torbie
4 Kittens
NO animal had feces on them PERIOD!!

Top cage is where Kenya was when they took her. I was in the process of cleaning her cage when we realized we were staked out, she normally went to the bottom cage while I cleaned out her cage while she was sick, but I didn't get that far. I took out her litter box to scoop it and fed her, but never got a chance to put it back. She was on medication that caused her to have diarrhea. They also state that she had no food/water, the wet food is what I gave her with her pill and she also had a small amount of dry food in which she ate. She was also given fresh water that morning when I gave her her Clavamox, cause that stuff is nasty and she hates it and I made her drink water to keep her hydrated.
This is the cage that housed 4 6 week old feral kittens. It was also stated there was no food or water. You can see the extra food clearly in this photo, even though their actual food and water bowls were on the floor of this cage. I put food on the trays when I am cleaning the litter box when I don't have time from them to play while I cleaned their cage. The tray show a mix of dry and wet food.
So tell me, where in these cages came animals covered in feces.
Harrison County couple facing animal cruelty, child neglect charges

Authorities say a child slept on a soiled mattress. (Source: Harrison County Animal Control.) Officers found feces and mold covered clothing. (Source: Harrison County Animal Control.)DEPAUW, INDIANA (WAVE) - A woman who ran a feline rescue operation is facing animal cruelty charges after Animal Control officers found "deplorable" conditions inside a Harrison County home.
Randall and Samantha Lee are facing charges after officials confiscated dozens of ill animals from their home.
"It made your nostrils swell shut and you would have involuntary gagging," said Bruce LaHue with Harrison County Animal Control.
That's how officers describe conditions inside the couple's Depauw, Indiana home.
"There was animal feces on flat surfaces of the floor. You had to be careful where you walked because most of the animals had diarrhea and the floor was very slippery in most places," LaHue told WAVE 3.
Pictures show clothes covered in both feces and mold.
"The condition of the house was atrocious. It would be what most people would consider to be unlivable," LaHue said.
Nearly three dozen cats, three dogs, and four chickens were living inside and outside of the home.
The arrest report of Randall and Samantha Lee also says a young child was living in the filth, forced to sleep on a soiled mattress, pictures show.
"We feel sorry for the kids that they have to grow up over there," said a neighbor who didn't want to be identified.
Neighbors say they knew something was up by the smell alone.
"We smelled manure on our front porch a lot."
A van with a "pet friendly" sticker was parked at the Lee's home when WAVE 3 stopped by, but only their older son was home.
The rescued animals were all sick when they were brought to the shelter, suffering from various diseases including upper respiratory infections.
"These cats eyes were matted shut when we got them and you can see one cat has damage to its right eye and that's probably going to be permanent," LaHue said.
Four felines had to be put to sleep.
The shelter's spent nearly $5,000 on lab tests and treatments, and has even lost business.
"While the cats were sick we had to suspend our adoption operation during one of the busiest times of the year," LaHue said. None of the animals are able to be put up for adoption because there's a pending lawsuit filed by the Lee's against the Animal Care Office in Harrison County. Their next court date is set for March of 2012.
In January of 2010, nearly two dozen animals were confiscated at that home, found living in similar condition, but the couple was never charged for animal cruelty.
They're now officially facing animal cruelty and child neglect charges for this recent raid, but the children are still allowed to live at the home.
The case started when a woman changed her mind an hour after trusting Lee to watch her two cats while the woman recovered from the flu.
When that woman called Lee to get her cats back, Lee's phone had been disconnected, so the woman called authorities which resulted in the discovery of the fifthly conditions.
The TRUTH to the lies above:
Feces did NOT cover the floors of the home. Yes, there was feces on the floor in by the litter boxes. And that is because the Lee's could not finish tending to daily chores because their home was being staked out.
No child slept on a soiled mattress
Officers found clothing that had been brought up from the basement lying in a pile of laundry to be washed that had dried gunk on it from things that were brought from the basement to be washed.
The home was a mess but was not deplorable. Had the Lee's left their adult son in the flooded basement and didn't care about his health or their personal belongings the house would not of been messy. Had Samantha refused to take her oldest son to an after school event and not help Jerri Warren prevent being evicted the house would had been cleaned the day of the raid. Because Samantha had errand after errand to do the day before the raid and Candace and Parker (the 17 and 14 year old children) were supposed to do their chores and did not do them, leaving everything untouched and for Samantha and Josh to do at 10:30 pm. Samantha grounded the children meaning, leaving all the undone chores for the children to do the following day when they got home from school.
I can't post on the comment LaHue made about the smell making you gag as that is a matter tied up in court.
There was not animal feces on the flat surfaces of the floor as LaHue would like you to believe. As I said, there was some on the floor by the litter boxes. You did not have to be careful where you walked because of animals having diarrhea and the floor was very slippery in most places. Samantha was bare foot from the time she got up that morning until after they left and Samantha cleaned the house that night BARE FOOT!
Pictures show clothes (about 6 pieces) that were rags, a dog bed, pillow case and a jacket that was being washed. That had gunk on it from them being brought up from the basement and went items from the basement laying on them.
The condition was not atrocious. Again, it was a mess due to the Lee's cleaning the flooded basement and trying to salvage their personal belongings and providing the adult son a dry place to sleep/call his room.
The arrest record is trumped up charges. No child was forced to sleep in the basement, like I have explained, that was the oldest childs bedroom, not a minor child and Samantha and Randell FORCED that child to move to the main floor. It is all lies to get back at Samantha for filing that tort claim.
Patty Mauck is the neighbor that did not want to be identified. She didn't tell you that her husband cussed out Parker and told him "if your m f ing dog gets in my yard again I am going to shoot and kill the m fer, this was after Parker was in the front yard playing with the Chocolate Lab and the neighbor whistled and Brownie thought they whistled for her, within seconds Parker was chasing her and got her within seconds of her going into there yard, this was said to him when he was 12 years old. Nor did she say anything when the adult son threatened to beat up Samantha for defending Parker by telling the neighbor it was not nice to speak to an Autistic child like that, let alone any child. And generally when you live across from horses you will smell manure, it is the country. The Maucks HATE animals.
Not all the animals were sick before the left the Lee's care. Photos prove that, vet bills prove that. LaHue is speaking of the kittens in this statement, their photo proves otherwise. They did have eye drainage at the time of the seizure, but not that morning.
Notice how it states 4 felines had to be put to sleep, but Otto Schalk said 4 felines died??? The truth is 2 cats died, 2 cat were put to sleep. I will post later why the cats had to be put to sleep, that is in litigation
The shelter did NOT spend $5000 "rehabilitating" the Lee's animals. They spent that money trying to find ways to get charges against the Lee's. Again, this is in litigation so I cannot speak of it fully, not to mention the vet charges $325 AN HOUR and most of the fee is the vet fee, not the lab work. And remember, Samantha had already given them nearly $100 of medication.
You don't want to suspend your business operation during the busiest time of the year then stop illegally seizing animals.
In January 2010 15 cats were taken ILLEGALLY and that CAN be proven and the photos prove the house was NOT in the same condition.
So now Jerri Warren had the flu? First it was to rehome her feral cat population to avoid being evicted, now it is reported 2 cats Samantha was supposed to watch for her. Even the news reporters don't know how to tell the truth.
Called to get her cats back??? She was being evicted, she begged Samantha to take them. Even after Samantha offered her ways to keep her feral population. Jerri Warren did NOT want those cats. Jerri Warren called Samantha after "business" hours the night of 11/16/11 and Samantha felt 11 pm was too late to return her call. The morning of 11/17/11 Samantha's phone was not on. Jerri Warren called at 8:17 am, by noon the authority was on the Lee's porch. Jerri Warren lives a good hour away from the Lee's and not to mention the bridge was closed down and had to take a different route to get there, not to mention get the Lee's address. Not to mention, the cats were going to a feral colony on 11/17/11 so Jerri Warrens cats would not had been at the Lee home anyway and Jerri Warren KNEW this!

Woman Files Lawsuit To Get Seized Animals Back
BY DANIEL KEMP WLKY CHANNEL 32
UPDATED 11:26 AM EST Feb 02, 2012 HARRISON COUNTY, Ind. -
The owner of a no-kill cat shelter who's accused of keeping animals in filthy living conditions is fighting to get them back.
More than 30 cats, as well as dogs and chickens, were taken from Samantha Lee's Harrison County home after it was searched in November.
She has filed a lawsuit against those who took them.
Both Lee and her husband face charges of animal cruelty and endangering their children after authorities said they found deplorable living conditions at their home.
But the couple said that's not the case and they're suing because of it.
The Frisky Felines Foundation website looks like a reputable service, but Harrison County Animal Control said it's not.
"It's the worst case I've ran into as far as animal neglect and cruelty," said Harrison County Animal Control officer Bruce LaHue.
Acting on a search warrant following a tip last November, LaHue took 36 cats, three dogs and four chickens from the home where Lee runs her no-kill shelter.
LaHue said officers found the floor covered in feces, rotting food, dirt and mold.
"A lot of the cats paws were stained with urine and feces because the cats had to stand in that environment," said LaHue.
In an animal control investigation report, veterinarians deemed many of the animals sick.
Documents showed cats suffered from viruses, open wounds and malnourishment.
LaHue said four have died, but the rest are improving at the Harrison County shelter.
"The cats are gaining weight, they're healthy," said LaHue.
But Lee wants them home. She has filed a lawsuit against LaHue, and in it she is demanding all animals be returned to her, claiming they were wrongfully seized.
"When we went there, we returned with what we said we saw, which were sick animals," said LaHue.
In the suit, Lee said Frisky Felines is a cage-free facility.
She said animal control arrived prior to cleaning hours and the seizure was based solely on the fact her family got behind on housework.
Still, LaHue said Lee neglected those animals and said the investigation proves it.
"She's not able to do what's necessary to run a rescue with this many animals," said LaHue.
Lee has also filed a separate lawsuit against not only LaHue, but Harrison County Animal Control, the council and board of commissioners.
It stems from a 2010 incident in which LaHue said more than a dozen cats and ducks had to be taken from the home.
In the lawsuit, the Lees are asking for $7 million in damages.
WLKY's Daniel Kemp tried to speak with the Lees at their home and by phone for this story, but a person who answered hung up.
LaHue said veterinarian bills for the 2011 incident topped out at about $7,000.
He said much of that was paid for through donations.
Meanwhile, the Lees are due back in court for their criminal case in March.

THE VIDEO
You can see from these pix of the cats on the bed, 11 shown here are NOT emaciated.
See picture of Abbigayle, Ashley, Smores, Chewbacca, Sagwa, Garfield, Sally, George, Izzie, Crystal
Cats you can see but hard to tell weight for you...Kenya, Kitler
Remember the state vet said 21 cats scored a 1-2 on the BCS
That leaves 14 cats I don't have pix of
I do have 5 more in pix not uploaded yet so that is 8 cats without pictures. And these are pictures taken DURING the raid by authorities, not by me and not my photos of our random pets.
So I ask, how can the state vet report be legitimate to say the least?
There are only 2 ways I know of, what do you think?
Not that I like to say I'm perfect, I'm not, I'm human. But to me, my kids are my kids, not doing chores while mom and dad are away, to me is a normal part of being a teenager and I do not fault my children. Yes, they should had done as they were asked, chores is not a surprise to them and I only ask 10 minutes a day from each of them to help keep the house clean. They just chose the wrong night to take advantage of me, and I chose the wrong day to help a person in need. Because of these actions, because we are "human", has cost us a ton of money, vacations, birthdays, school, reputations, and the life of many of our beloved pets. But there is one thing I can say, when it comes to loving our family, loving animals, caring for the environment, and helping others, we are perfect.
This is a video I made and dedicated to my children who are guilt ridden over this and very much want their lives back, but even more want their pets back.
